Ten Provisions You Should (and Should Not) Have in Your Business Contracts

On Thursday, November 8, 2018, Yukevich | Cavanaugh associate Adam presented a seminar for members of the Manhattan Beach Chamber of Commerce, entitled “Ten Provisions That You Should (And Should Not) Have in Your Business Contracts.” Mr. Doupé provided an example and solution for each of the ten provisions. The first and most important provision, Mr. Doupé stated, is to "make clear, affirmative statements about rights and duties of contracting parties." Use "shall" and AVOID using "may" or "can" because it leads to voluntary actions. The Chamber reports that “… Once the presentation started, the audience became highly engaged and asked many important questions,” and that overall it was a “great seminar.”
