Imaging Advisor, Inc. v. General Plastic Industrial Co., Ltd.

2012 – Orange County, California

The case arose out of an alleged breach of a consulting contract wherein plaintiff initially claimed in excess of $4 million in damages.  Through discovery, the defense demonstrated that there was no merit to plaintiff’s initial claims.  At the time of trial, the Court had to decide whether (1) plaintiff was entitled to a limited amount of fees for the time period during which the plaintiff company was given notice of termination, or (2) for the remainder of the three-year consulting agreement.  After a four-day bench trial, the Judge interpreted the contract consistently with the defense and denied plaintiff’s claim for three-years of allegedly guaranteed fees.
