Lainez v. STAT Services, Inc.

On Tuesday, August 20, 2019, Yukevich Cavanaugh achieved a noteworthy victory for water damage remediation company STAT Services, Inc. (“STAT”). Judge Linda S. Marks granted STAT’s motion for summary judgment, dismissing all claims brought by plaintiffs Robert, Stephanie, and Harrison Lainez. 

STAT was hired to perform water and mold remediation at plaintiffs’ residence. Following the completion of STAT’s work, plaintiffs alleged STAT failed to properly remediate mold in the home, leading to significant property damage and respiratory injuries to the family. Plaintiffs sought damages of more than $1 million. 

STAT moved for summary judgment, asserting that plaintiffs could not set forth any facts that evidenced STAT was liable for plaintiffs’ purported injuries or damages. Further, the Court sustained STAT’s objections to plaintiffs’ expert materials, where STAT argued that the materials were procedurally inadmissible.
